1General Information & Acceptance
These Terms of Service ("Terms") govern your access to and use of the Probemas platform at www.probemas.com and related pages (the "Platform"), operated by Virtual Gaming Solutions LP, 272 Bath Street, Glasgow G2 4JR, United Kingdom ("Probemas", "we", "us"). By creating an account, placing an order, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.
2Eligibility & Age
You must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) and legally able to form a binding contract to use the Platform. By using the Platform you represent that you meet these requirements. We may, at our discretion, verify your age, identity, and nationality, and may refuse or suspend service where verification is not completed (see Section 12).
3Our Role — Marketplace & Intermediary
Probemas operates as an online marketplace and intermediary. For in-game currency ("gold") and tradeable in-game items, the Platform connects buyers with independent third-party suppliers who own and supply the goods. Probemas facilitates these transactions — providing the venue, processing payment, coordinating delivery, and administering buyer protection — but does not itself own the gold or items so supplied. The contract of sale for such goods is formed between the buyer and the supplier; Probemas acts as the suppliers' commercial agent and facilitator for the purpose of concluding and settling that sale. For accounts and in-game services, Probemas may act as principal or may coordinate delivery through vetted service providers; where Probemas is the principal, these Terms apply to Probemas directly as the seller.
4Third-Party Suppliers & Vetting
Suppliers on the Platform are independent third parties, not employees or agents of Probemas beyond the limited settlement agency described in Section 3. We take reasonable steps to vet suppliers for reliability and to remove those who breach our supplier terms, but we do not guarantee the identity, conduct, or tax status of any supplier. Suppliers are solely responsible for their own tax obligations (including any VAT) arising from their supplies through the Platform.
5Payments, Funds Flow & Card Data
We collect payment from you at checkout through our third-party payment processors. By checking out you agree the charge is authorised. Payments may be handled by one or more PCI-DSS-compliant payment processors, which may vary by payment method, region, and over time; we do not receive or store your full card number or security code.
One-time purchases only. All purchases on the Platform are one-time. We do not operate subscriptions, do not automatically renew or repeat any charge, and do not store your payment credentials for future or recurring billing.
Where goods are supplied by a third-party supplier, Probemas collects the purchase price on behalf of the supplier and remits the supplier's share, net of Platform fees, to an account in the supplier's own name; third-party payout redirection is prohibited.
6Buyer Protection & Delivery
We stand behind delivery. If an order is not delivered, or is materially not as described, you are entitled to a full refund of that order, provided you raise it with us before the order is marked delivered/complete (see Sections 11 and 23).
Suppliers are paid only once delivery is completed. We maintain records confirming that each order has been delivered; these delivery records may be used to verify fulfilment and to help resolve payment disputes.
7Products, Prices & Fees
The Platform lists our available products and services (a non-exhaustive list; contact us for more). Prices shown are per unit; use the on-site calculator to see the final price, also confirmed at checkout. By proceeding to checkout you agree the relevant charges are recognised. We may change prices, promotions, and fees at any time; changes do not affect orders already placed.
8Product Descriptions & Accuracy
We make extensive efforts to keep product and service descriptions clear and accurate, and you may request clarification via our Contact page before ordering. If you consider a description inaccurate or misleading before delivery, you are entitled to request a refund. By participating in the completion of a delivered order, you accept that its description was accurate; delivered orders are therefore not subject to "not as described" disputes except where Section 6 (materially not as described) applies.
9Order Delivery
Under no circumstances will we ask you to return an order after it has been delivered.
10Account Purchases & Safety
On receiving an account, you are responsible for immediately changing the password, updating the recovery email where applicable, reviewing linked logins, and ending active sessions to secure the account. For legacy accounts we strongly advise not importing into a personal Jagex Account immediately: use the account as a legacy login for at least 30 days on the same IP/device/location before importing, avoid early real-world-trading activity, build sufficient playtime first, and prefer game items over raw gold where possible. Probemas is not responsible for security locks, restrictions, or other actions occurring after an account is imported into a personal Jagex Account, or for any action by the game publisher outside our control.
11Refund & Return Policy
You may cancel and request a refund at any time before delivery. Payments for successfully delivered orders are final and non-refundable, except as provided in Section 6 and by your non-excludable statutory consumer rights.
All goods sold are digital goods, delivered immediately and irrevocably. We also reserve the right to refuse service and refund the relevant transaction. Refund timeframes are provided by our support team via the Contact page.
12Identity Verification, AML & Sanctions
For certain payment methods we may require additional verification, used solely to prevent fraud. This may include social-media verification, a government-issued photo ID, a phone number, or other information. We may also, at our discretion, request identity verification from any customer where we consider it necessary to verify an order or protect against fraud, and we may refuse to do business with anyone who does not complete requested verification.
Anti-money-laundering & sanctions. We are committed to preventing fraud and money laundering. We do not knowingly provide services to individuals or entities located in, or subject to, sanctions administered by the United Nations, the United Kingdom, the European Union, or the United States (including OFAC-listed persons and jurisdictions). We monitor transactions for fraudulent or suspicious activity, may verify the source and legitimacy of funds, and may decline, delay, or report any transaction where we have reasonable grounds for concern.
13Fraud, Chargebacks & Recoupment
Use of a VPN/Proxy/VPS to disguise your identity or location may result in immediate termination of services. If a payment is reversed (e.g. a chargeback) after we have completed an order, we reserve the right to deduct the reversed amount from your future orders and to withhold or seize related payments to recover the resulting loss. Fraudulent activity may be reported to the payment provider and relevant authorities.
14Prohibited Uses & Account Termination
You agree not to use the Platform to:
(a) pay using stolen, fraudulent, or unauthorised payment methods;
(b) launder money or transfer the proceeds of crime;
(c) make purchases for any unlawful purpose;
(d) use the Platform if you are under 18;
(e) provide false information or impersonate another person; or
(f) abuse, defraud, or attempt to circumvent our fraud-prevention or verification controls.
We may suspend or terminate access, cancel orders, and report activity to the relevant authorities where these Terms are breached.
Suspension & closure at our discretion. We further reserve the right, at our sole discretion and with or without cause or prior notice, to refuse service, suspend or restrict your access, and to close or permanently delete your account at any time. On the closure or deletion of an account, any unredeemed Loyalty Points, rewards, reward-chest contents, and store credit associated with it are forfeited — Loyalty Points and rewards have no monetary value and confer no property right. This does not affect goods you have already paid for and received, or your non-excludable statutory consumer rights.
15Selling to Probemas / Supplying Through the Platform
If you sell in-game currency or items to Probemas, you warrant that you are the lawful owner of what you supply, that it was obtained legitimately, and that its transfer does not breach any third-party terms. We may verify, delay, or decline any purchase and may recover sums paid for goods later found to be fraudulent, charged back, or reclaimed. Where the Platform supports peer-to-peer supplier listings, the supplier terms in Sections 3–5 additionally apply.
16Account Bans & Character Termination — Risk Disclaimer
By purchasing goods or services relating to a game account, you accept all risk to your in-game account or character. Publishers such as Jagex may, at their discretion, penalise, restrict, or ban accounts that use third-party gold, items, accounts, or services. We accept no responsibility if your account receives any penalty in connection with our products or services. We provide risk-reduction guidance (Section 10) but cannot and do not guarantee against publisher action.
17Rewards & Loyalty Points
Rewards redemption. Rewards earned through the Platform must be redeemed within 14 days of issuance; unclaimed rewards expire automatically and cannot be reinstated. Rewards are non-transferable and usable only by the account holder who earned them. We may modify or terminate the rewards programme at any time without prior notice.
Loyalty Points — use & expiry. Loyalty Points are earned through purchases, promotions, or purchased directly. All Loyalty Points expire after twelve (12) months of account inactivity. Signing in, placing an order, or redeeming Points (e.g. opening a reward chest or entering a raffle) keeps the account active and resets the twelve-month period. Expired Points cannot be reinstated. We may review, adjust, or void Points in cases of suspected fraud or misuse. Points and rewards are also forfeited on the closure or termination of an account (see Section 14). "Inactivity" means no sign-in, order, or Points redemption for a continuous twelve (12) months.
Amendments. We may modify these programme terms at any time; updates are posted on the Platform, and continued participation constitutes acceptance.
18Intellectual Property & Non-Affiliation
Our IP. The Probemas name, logo, site design, original artwork, text, and all other original content on the Platform are owned by or licensed to Virtual Gaming Solutions LP and may not be copied, reproduced, or used without our prior written permission.
Your content. By submitting reviews, chat messages, or other content to the Platform, you grant Probemas a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purpose of operating and promoting the Platform. You retain ownership of your content and warrant that it does not infringe any third-party right.
IP complaints. Rights holders may report allegedly infringing material through our Intellectual Property Complaints procedure by contacting legal@probemas.com. We review complaints promptly and remove or disable material where warranted.
Non-affiliation. Probemas is an independent marketplace. Probemas is not affiliated with, associated with, authorised by, endorsed by, or in any way officially connected to Jagex Ltd or any other game publisher. RuneScape® and Old School RuneScape® are trademarks of Jagex Ltd; all other game names, marks, and logos are the property of their respective owners. Third-party game names and marks are used only nominatively and descriptively to identify the games to which our products and services relate, as permitted under section 11 of the UK Trade Marks Act 1994 (honest descriptive use).
19Disclaimer of Warranties ("As Is")
The Platform and all products and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, and we do not warrant uninterrupted or error-free operation. Nothing in this section removes or limits any warranty or right you have that cannot be excluded under applicable consumer-protection law (see Section 22).
20Limitation of Liability
To the fullest extent permitted by law, Probemas will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for lost profits, data, or goodwill, arising from your use of the Platform. Our total aggregate liability for any claim will not exceed the greater of (a) the amount you paid for the specific order giving rise to the claim, or (b) the total amounts you paid to Probemas in the twelve (12) months before the claim arose. Nothing in this section limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law, including your non-excludable statutory consumer rights.
21Indemnification
You agree to indemnify and hold harmless Probemas and its affiliates, partners, officers, and employees from any claims, losses, liabilities, and reasonable costs arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.
22Governing Law
These Terms and any dispute arising from them are governed by the laws of England and Wales, without regard to conflict-of-laws principles. This does not deprive you, if you are a consumer, of the protection of any mandatory consumer-protection provisions of the law of your country of residence, nor of your right to bring proceedings in your local courts where that right cannot be excluded.
23Dispute Resolution — Talk to Us First
If you have a problem, contact us first at support@probemas.com so we can try to resolve it. Both parties agree to attempt good-faith resolution for 30 days before starting any formal proceedings, and, while an order is still open or pending, to use our internal dispute process rather than initiating a chargeback or third-party claim. If we cannot resolve it, the dispute may be brought before the courts of England and Wales (subject to your consumer home-court rights in Section 22).
24Arbitration & Class-Action Waiver
Any dispute not resolved under Section 23 may be referred to final and binding arbitration on an individual basis only; you and Probemas waive any right to bring or participate in a class or representative action. This section does not apply where prohibited by applicable consumer-protection law, including for consumers in the United Kingdom and the European Union, whose rights to bring claims before their local courts are unaffected.
25Modifications to These Terms
We may amend these Terms from time to time. Material changes will be posted on the Platform with at least 14 days' notice before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance. If you do not agree to a change, stop using the Platform.
26Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
27Entire Agreement, Assignment & Contact
These Terms (with any policies referenced in them) are the entire agreement between you and Probemas regarding the Platform. We may assign these Terms as part of a reorganisation or sale; you may not assign yours without our consent. No failure to enforce a provision is a waiver of it.
